Yes, we can confirm that the grace period notice provisions in the Illinois Code of Civil Procedure were automatically repealed on July 1, 2016. To our knowledge, this change was not broadly communicated by any Illinois agencies, such as the Illinois Department of Financial and Professional Regulation (IDFPR).

In the Illinois General Assembly’s most recent session, three amendments to Senate Bill 568 were introduced to reenact these grace period provisions, with varying modifications in each of the three amendments. For now, that bill is dead, but it remains possible that the General Assembly will reinstate some form of the grace period provisions at a later date, either in Senate Bill 568 or another bill.
