Is a power of attorney still effective if the principal’s address has changed from what is listed on the power of attorney document? – IBA Compliance Connection

Is a power of attorney still effective if the principal’s address has changed from what is listed on the power of attorney document?

by

Yes, the power of attorney is still valid. The Illinois Power of Attorney Act provides that a power of attorney continues to be effective until the principal dies or the power of attorney specifies an earlier termination date. We do not believe that the principal’s change of address would affect the validity of the power of attorney.

For resources related to our guidance, please see below:

  • Illinois Power of Attorney Act, 755 ILCS 45/2-5 (“Unless the agency states an earlier termination date, the agency continues until the death of the principal, notwithstanding any lapse of time, the principal's disability or incapacity or appointment of a guardian for the principal after the agency is signed.”)
